Heather Locklear just got her driving under the influence case dismissed, and she's pled to a much lesser offense.
Heather pled no contest to reckless driving, a misdemeanor. She'll be placed on three years informal probation, pay a $700 fine, and she must attend a 12-hour drug education course.
Heather was arrested last September after she was allegedly driving under the influence of prescription meds. The D.A. says Locklear's blood tests showed prescription drugs were indeed in her system. No alcohol was involved.
Score one more for the unbeatable Blair Berk, who seems to work mini-miracles for some of these celebs who cross the legal line. Berk was in Santa Barbara court this AM for the plea. Locklear was not there.

After recently getting busted for a DUI last month, Heather Locklear isn't taking any chances in the driver's seat.

Locklear hit Orso in LA on Thursday, where she was so nervous about having to move her sweet 7 Series BMW out of the jam packed lot -- she had the valet do it instead. If only he was around back in September ...

Heather hit up the happiest place on earth to attend Miley Cyrus' seven-weeks early Sweet 16 birthday party.
Disneyland fun fact: No alcohol is sold to the general public inside the park.

The California Highway Patrol has released the arrest report from Heather Locklear's DUI bust:
"A concerned citizen observed a visibly impaired woman, later identified as Heather Locklear, at a parking lot in Montecito, CA. Ms. Locklear was driving forwards and backwards over a pair of sunglasses and revving her engine. A few moments later, that citizen watched Ms. Locklear drive away. The citizen left the parking lot and came upon Ms. Locklear and her vehicle now stopped within the roadway on east Valley Road, near Live Oaks Road, in Montecito.
The citizen became concerned when Ms. Locklear exited her vehicle and stumbled into the traffic lane. Concerned for Ms. Locklear's safety, the citizen called 911 and reported the entire incident to CHP Ventura Dispatch.
CHP Dispatch broadcast the situation to officers in the area. Santa Barbara CHP officers responded to the area. Upon arrival, they located Ms. Locklear seated alone in the driver's seat of her vehicle which was obstructing the traffic lane.

The woman who called 911 on Heather Locklear says she never gave the paparazzi a heads up, according to her lawyer.
Attorney Nick Tepper, who reps Jill Ishkanian, tells "Extra," "At no time did my client call the paparazzi."
So where on earth did TMZ get off saying that she immediately called a paparazzi agency after calling 911? Well, we'll tell you.
Marc Mann, owner of KM Press Group, told TMZ Sunday night that Ishkanian did indeed call him after she called 911. KM got the arrest photos, which TMZ obtained and published.
We asked Mann why Ishkanian would call him. He told us Ishkanian knew they had shot Locklear approximately an hour before the arrest. Mann says they stopped shooting Heather because nothing eventful was happening.
The KM photog was a half mile away from Locklear, shooting someone else, when Mann says he got the call from Ishkanian.
By the way, Mann was on the phone with Ishkanian Tuesday night, immediately before he told us she was the one who tipped him off.

CHP sources in the office investigating the Heather Locklear case tell TMZ the motives of the woman who called 911 are irrelevant -- and we're now told there are other witnesses who will back up her story. The case is now in the hands of the prosecutors.
One CHP official told us that up until we posted our story last night, they were unaware that Jill Ishkanian -- the woman who called 911 -- had called a paparazzi agency immediately after she made the emergency call. But the official says it has no bearing on the case. He told us the case file already has been referred to the Santa Barbara County D.A. and it's being reviewed right now. He added the decision on whether to prosecute will be based on the results of drug testing -- due in around three weeks.
The official says since the arrest, the CHP has received calls from other people who tell the same basic story Ishkanian told. He says Ishkanian went to the cop shop on Saturday night and gave a written statement of what she saw and also told her story, which is on tape. He added, "There's no reason to believe the witness is less than credible."

This is the craziest story ever. The woman who called 911 on Heather Locklear is a former Us Weekly staffer who was under investigation by the FBI -- and she's the one who tipped off the paparazzi!
Jill Ishkanian, who allegedly hacked into Us Weekly's computer system to locate celebs after she left the mag, was following Locklear in the Montecito area. Ishkanian watched the actress go to a market. When Heather got in her car, Ishkanian called 911, even though the car wasn't even moving at the time.
Now get this -- sources say immediately after Ishkanian called 911, she called a paparazzi agency to give them the heads up Heather was about to be popped. TMZ obtained those photos, not knowing it was Ishkanian who set the ball in motion.
And it gets worse. Ishkanian apparently is the only witness who says Locklear was driving erratically and that she was drunk, even though it's already established she was not under the influence of alcohol.
Sound underhanded? That's what we're thinking ...

So we got the pictures of Heather Locklear's DUI arrest. One in particular that has nothing to do with cops caught our attention yesterday -- the ring.

Take a look at the CHP officer on the right, taking a picture of Heather Locklear on his cell phone just before she gets cuffed.
It's not a CHP cellphone -- the Department tells TMZ it's owned by the officer. So, you ask, why is the officer taking pictures of Heather Locklear on his personal cell phone? Officials in the Santa Barbara CHP office say he was documenting the scene with video and photos -- partly for evidence and partly to protect the officers in case Heather claims some sort of impropriety.
The officials say the video and photos are being turned over to the D.A.'s office as evidence and nothing was improper about the officer using his cell phone to document the arrest. But we spoke with several others at CHP who say officers shouldn't be using their personal cellphones, especially when a celeb is the suspect.

TMZ has obtained photos of Heather Locklear's DUI arrest on Saturday near Santa Barbara. The actress looks somewhat dazed as she's taken into custody. But after taking a closer look, she could have an interesting defense.

A resident called authorities after allegedly seeing Locklear driving "erratically" in a parking lot. But the CHP didn't see her driving -- she had pulled over on her own accord before they got there. There are reports she was arrested for driving under the influence of prescription medication -- but we're told the tests are still being analyzed. As we posted yesterday, no alcohol was involved.
The bottom line -- Locklear has a lawyer with a Ty Cobb batting average, Blair Berk. Especially given that deputies apparently didn't see her driving, look for a plea bargain and very possibly a reduced charge -- e.g., reckless driving.
By the way, check out the huge rock on her finger. She was apparently staying at the San Ysidro Ranch in Montecito with Jack Wagner.

Heather Locklear was arrested last night in Santa Barbara and booked on suspicion of driving under the influence -- cops think she was on prescription meds.
A resident reported Heather was "driving erratically" while pulling out of a parking lot. The California Highway Patrol then found Locklear's car parked on a state highway and blocking a lane. After talking with her, the officer determined she was under the influence of something and arrested her.
She was tested for drugs and alcohol. As we first reported, law enforcement tells us alcohol was not a factor. They are conducting drug tests.
She was released without having to post bail.

TMZ has learned Heather Locklear was arrested yesterday on suspicion of driving while impaired.
Locklear was pulled over while driving in the Santa Barbara area.
Law enforcement officers tell us alcohol was not involved, but they are conducting tests to determine if Locklear was under the influence of drugs.
We're told she was released on her own recognizance, without having to post bail.
This could set up a bizarre custody battle given that Locklear and ex-hubby Richie Sambora have both been busted for similar charges.
Sambora pleaded no contest to DUI back in March -- his daughter Ava was in the car at the time he was popped. We're told Heather's kid was not in the car when she was arrested.
In June, Heather checked herself into an Arizona medical facility to fight anxiety and depression.

Heather's reps have yet to get back to us.
