Ashley Dupre Gone "Wild" -- Legal or Jailbait?

TMZ has learned that Ashley "Spitzer-Girl" Dupre may have been underage when she was filmed nekkid on the "Girls Gone Wild" bus. Her lawyer, Don Buchwald, tells TMZ Ashley's birthday was April 30, 1985, and the footage was shot between March 13 and March 20, 2003, making her 17.

But "Girls Gone Wild" chieftain Joe Francis says even if she was 17, Florida and Federal law -- and Joe knows a thing or two about that -- permits her to be filmed in any state of undress ... as long as she consents and there is no "sexual contact." (And there was none, Joe says.)

However, in a statement to TMZ, Joe says his outfit has a "corporate policy" not to use girls under 18, and thus has "delayed the release of Ms. Dupre's nude footage on the Internet and are investigating the matter."

123. I actually had some feelings of compassion for this girl. maybe it was just the wrong time, she was just trying to get money for her career. And then this comes to light. it's just sad. Don't give me this BullCrap that she came from a bad life and this is how she supported herself. She was letting it all hang out when she was 17 without any money. But ya know that's not good but be young and dumb. But 5 years later and you're still doing the same thing, but now you get paid. Wake up sweetie. All you're good at is being on your back.

127. Jealousy?? She is a beautiful girl with a great body, who made the wrong decisoins at a young age! Too many people live in glass houses! She wasn't harming anyone by selling drugs! The only life she has put in dissaray is her own! The governor did it to himself, if it wasn't her it would have been someone else! Give her a break...if your reading it your feeding into it and you must be interested! 131. spitzer and dupre were walking down the street when spitzer bends over and looks under dupre's dress, spitzers says 'mmmm. it's a wonder!".. dupre smiles and they continue walking. bit later spitzer does the same, looks under dupre's dress and says 'it's a wonder!'. dupre, getting enthused starts to imagine. spitzer a third time looks under her dress and say's 'girl, it's a wonder!'. dupre finally basking in the compliment asks spitzer 'sweetie, whats the wonder?'. spitzer looks to her and says 'it's a wonder your guts don't fall out.'.
